According to Hester Pierce, SEC Commissioner, the crypto asset regulation bill (MiCA) passed by the European Parliament and the UK's approach to digital asset regulation could be a starting point for the US regulatory framework.
According to her:
"We’re shooting ourselves in the foot by not having a good regulatory regime in the US. I share with you the approach of telling people ‘look, there are risks here, you can choose to opt into those risks or opt out.’ And then trying to figure out a regulatory model that allows for innovation."

Peirce has admitted she is not very optimistic about the prospects for reducing regulatory uncertainty in the US.
In February, the commissioner urged the Congress to accelerate the development of a regulatory framework for cryptocurrencies.

A month earlier she said that the community and regulators should learn from the challenges faced by the industry.
Since early 2023, the SEC has flagged violations in the operation of Bittrex, Coinbase, Kraken, Gemini and Genesis.
