According to a new order issued by Northern District Court of California, judge Vince Chhabria has dismissed Jeffrey Berk’s lawsuit against Coinbase due to not “clearly and unmistakably” delegate arbitrability to the arbitrator.

The order states:

“Coinbase’s motion to compel is therefore denied, but without prejudice to its renewing the motion if Berk’s next iteration of claims relates directly to the parties’ contractual relationship.”

Jeffrey Berk states that Coinbase had engaged in insider trading by alerting its own stuff-members that Coinbase would fully support bitcoin cash (BCH) at a later date, after publicly stating that they would not.

1-0 in favor of Coinbase, given the fact that it might be preparing for an initial public offering (IPO).
